USE OF THE SPOTLIGHT WEBSITE

By using the Spotlight website www.spotlight.com, you agree to the terms and conditions below.

Definitions

“You” means the user of the Site, “We/us” means Spotlight, “website” or “Site” means the sites located at www.spotlight.com and www.spotlightagent.info on the World Wide Web, “Content” means the information and other material available within the Site.

Rights granted / rights reserved

You agree not to (or to facilitate any third party to) copy, transmit, distribute, publish, commercially exploit or create derivative works of the Content without prior permission from Spotlight.

Warranty

The site and the content (which includes Content that is supplied to us by third parties either directly or indirectly) is provided on an "as is" and "as available" basis and we make no warranties or representations, whether express or implied, in relation to the Site or the Content, including but not limited to, implied warranties or conditions or completeness, accuracy, satisfactory quality and fitness for a particular purpose.

Liability

You agree that Spotlight shall not be liable for any loss or damage whatsoever arising directly or indirectly from or in any way connected with the Site or your use of or reliance upon the Content or any information you obtain by means of the Site, or your use of or reliance upon the Content or any information you obtain by means of the Site or any bookings or purchases you make from third parties through your use of the Site, including, without limitation, damage for loss of profits, loss of business, or any other consequential or pecuniary loss (even where we have been advised of the possibility of such loss or damage).

Notwithstanding that appropriate steps have been taken to ensure that the information in our directories is accurate, Spotlight (and those organisations on whose behalf we publish various directories) cannot accept liability for reliance placed on the contents and/or any omissions which may occur. Those employing performers or specialists from our directories must make their own enquiries of the performer / specialist to satisfy themselves that he/she is competent to perform the skills required.

You agree and acknowledge that you are solely responsible for evaluating any goods or services offered by third parties via the Site. You acknowledge any bookings or purchase of goods or services made with a third party via the Site shall be subject to the terms and conditions of the third party supplying the service and/or goods concerned and that we will not be a party to or in any way responsible for or liable to you in respect of any transactions between you and third parties.

We do not make any representations or warranties as to the security of any information you might be requested to give to any third party.

Availability of the site

You acknowledge that faults may lead to temporary unavailability of the Site and related e-mail services; and that the operation of the Site and related e-mail services may be adversely affected by conditions and performances outside our control, including, without limitation, transmission and telecommunications links between us and you and between us and other systems and networks.

Links to other sites

We may provide links to other websites. You acknowledge and agree that we are not responsible for the availability of such external sites, and do not endorse and are not responsible or liable for any content, advertising, products, services or other materials on or available from such sites.

Use of the site

You undertake:

  1. not to use the content or e-mail services for any unlawful purpose;
  2. that you shall not make any use of the Site or e-mail services such that the whole or part of the Site is interrupted, damaged, rendered less efficient, or the effectiveness or functionality of the Site is in any way impaired;
  3. not to use the Site or its e-mail services for the transmission or posting of any computer viruses or any material which is defamatory, offensive or of an obscene or menacing character, or in such a way as to cause annoyance, inconvenience or needless anxiety; and
  4. not to use a hotlink to a performer's web-page on any publicly accessible internet site without their express permission. You also agree to remove any link to a performer's web-page on their request.

Forwarding enquiries to Spotlight members

Spotlight offers an enquiries (forwarding) service for its members which is for professional casting / agent messages only. No other messages or information will be forwarded to members.

Spotlight has a duty of care to its members and reserves the right not to forward any material it deems inappropriate or offensive.

Intellectual property

You acknowledge that all copyright, trademarks and all other intellectual property rights in the content shall remain vested in us.

Changes to these terms and conditions

We reserve the right to change these terms and conditions from time to time. By continuing to use the Site following such change you will be deemed to have accepted such change. It is your responsibility to regularly check these terms and conditions. If you do not agree to any changes made to them you must immediately stop using the Site.

Entire agreement

These terms and conditions (as amended from time to time) together with any document expressly referred to in them comprise the entire agreement between you and us.

Severability

Each provision of these terms and conditions excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other provisions is held to be inapplicable or unenforceable in any circumstances.

No waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

English Law

These terms and conditions shall be governed by English law and you submit to the exclusive jurisdiction of the English Courts.

All Agents and Performers wishing to receive breakdowns via The Spotlight Link must agree to the following terms and conditions

1. The information in e-mails sent by casting professionals using The Spotlight Link is the confidential property and copyright of the sender (or of his/her employer). In using The Spotlight Link, you agree not to forward or copy these e-mails to anyone else and that you will only use them, and the information set out in them, for the purposes of suggesting clients (as an agent) or yourself (as a performer) for the relevant casting opportunity, by using the link provided in the system to send e-mails back to the relevant casting professional.

2. For data protection reasons, you need to satisfy yourself as an agent that the clients whose details you send using the system consent to this. You also now consent to your own details being made available via The Spotlight Link to casting professionals, for them to use to send you casting breakdowns.

3. Any breach of the Conditions of Use could cause inconvenience and loss to the sender, and loss to Spotlight. Spotlight reserves the right to terminate your access to The Spotlight Link without notice in the event of a breach. It also reserves the right to withdraw or withhold The Spotlight Link service for individual agents, performers or generally, where it considers this to be commercially desirable or for any other reason it deems appropriate. To ensure quality of service for our advertisers and subscribers, we may withhold access to The Spotlight Link from agents or performers whom we consider to lack the relevant credentials or professional experience.

4. These Conditions of Use are governed by English law and the courts of England and Wales have exclusive jurisdiction over matters arising out of them.

Uploading photos, video and audio clips to Spotlight CVs

It is the responsibility of the Spotlight member or agent to ensure that they have full copyright clearance for all photography, voice clips and showreels uploaded or supplied to Spotlight as part of Spotlight membership.

Photographs
A performer or agent submitting photographs to Spotlight must provide us with the name of the photographer for all images. Photographers must be credited, according to copyright law. We reserve the right to refuse any photograph which we consider unsuitable or inappropriate.

Showreels and voice reels
Copyright is a legal right which exists in literary, dramatic, artistic and musical works. If you are taking a clip from previous professional work, in most cases the producers of that work will either have rights assigned to them or at least, a licence to the rights. Producers normally grant permission for you to use short clips completely free of charge - but you must check with them first and get their permission in writing. If you are recording a clip from scratch especially for a showreel or voice reel, remember that most 20th century scripts are still subject to copyright, and you should seek permission from the publisher.

Under Spotlight's terms a performer or agent who wishes to upload a show reel or voice reel bears the responsibility for clearing any material used. If there is any sort of dispute, Spotlight will take the material offline until the performer or agent who uploaded the material clears the right to use it.
Spotlight users must not upload material that is unlawful, defamatory, abusive, obscene, discriminatory or otherwise inappropriate.

Spotlight reserves the right to suspend or withdraw media upload facilities from members and agents who violate our terms & conditions, and to remove material which it considers to be in breach of these terms & conditions.

Spotlight reserves the right not to broadcast any material which it deems inappropriate.

Additional Services

The following additional services are available to Spotlight members and their agents. By agreeing to these terms and conditions, you agree to the terms set out below in relation to such services and the related guidelines, policies and prices in relation to each service accessible by using the specific links below.

Multimedia Services:

Photograph Upload - Where a member or agent requires Spotlight to upload a photograph on their behalf they agree to the price related to this service appearing on our website at the date their request is made. They also agree to adhere to the guidelines relating to supplying photographs appearing on our website. Video Upload - Where a member or agent requires Spotlight to upload a showreel on their behalf they agree to the price related to this service appearing on our website at the date their request is made. They also agree to adhere to the guidelines relating to supplying video appearing on our website. Audio Upload - Where a member or agent requires Spotlight to edit and upload an audio clip on their behalf they agree to the price related to this service appearing on our website at the date their request is made. They also agree to adhere to the guidelines relating to supplying audio clips appearing on our website. Premium media upgrades:

Members or agents are entitled to cancel a premium media upgrade up to 14 days from the date of purchase, in which case a full refund will be given. After 14 days, no refund will be available.
Media services will be withdrawn upon expiry or withdrawal of an individual's Spotlight membership(s). No full or partial refunds will be available in respect of premium media services in these circumstances.

When a member or agent upgrades to 15 minutes' media (per CV) after previously upgrading to 10 minutes' media (per CV), the full upgrade fee for 15 minutes' media (per CV) will be payable, regardless of an upgrade already having been paid for.

Spotlight reserves the right to delete all or some of a member's media on expiry of their premium media upgrade, expiry of their Spotlight membership(s) or for any other reason, including, but not limited to, withdrawal of media upload services for whatever reason.

Spotlight does not offer members or agents the ability to download or otherwise recover media files in their original quality or format. Spotlight therefore strongly recommends that members and agents retain their original media files. Furthermore Spotlight cannot be held responsible for loss or corruption of data, including accidental or intentional deletion by any party.

Spotlight Studio Services:

Spotlight Monologue - A Spotlight Monologue is an opportunity for performers to have a scene of their choice recorded and uploaded to their Spotlight CV. We are unable to offer refunds relating to this service. Information and prices can be found using the following link: http://www.spotlight.com/artists/spotlightmonologue.html.

Spotlight Actor On Tape - "Actor on Tape" allows customers to use our state-of-the-art casting studios, often at short notice, to record and email casting clips. The recorded scenes are streamed to a website and customers can then send a link to third parties. Bookings are based on an hour of studio time. Showreel Editing - Customers can spend the day with one of our professional editors turning their video material into a showreel (based on a 6.5 hour day). We also offer an hourly service should a customer require less time. We offer follow-up edits, amendments and additions also based on an hourly rate. If you are a current Spotlight member, or the agent of a current Spotlight member, footage created during your session can then be uploaded to the Spotlight member's online CV. Technical specifications for the video material, current prices and our cancellation policy can be found using the following link: http://www.spotlight.com/artists/ShowreelEditing.html.

Your online reservation (where applicable) does not legally oblige you to fulfil the booking.
Cancellations can be made through BookingBug at any time prior to the telephone consultation, or in person during the consultation itself. Spotlight will require credit/debit card details in order to confirm your booking. These details will be taken during the telephone consultation and held securely. No payment will be taken or funds secured. Payment will be taken on the day of your appointment via cash or card (the card can be different to that detailed above). Subsequent to the telephone consultation an appointment may be rescheduled by telephone or email at no cost. Any cancellation or failure to attend will result in a cancellation charge (based on 50% of the full day rate).

All appointments start at 10.00. Please arrive in good time at Spotlight (1st Floor, 7 Leicester Place, London WC2H 7RJ). The building is open from 0930.
Appointments are based on a 6.5 hour day with an hour lunch break. Should your edit take significantly less that the full day, a deduction in cost will be made based on the hourly rate. A minimum charge of three hours applies. The lunch break will take place between 1300 and 1400. Kitchen facilities are available should you wish to stay in the building. Please ensure you are ready to resume the edit at 1400. Complimentary teas, coffee and biscuits are available throughout the day.
Appointments will finish no later than 17.30. By the end of the day you will receive five DVD copies of the completed showreel, each labelled with a case. The showreel will also be uploaded to the member's Spotlight webpage. This may take up to 24 hours to go live. Your editor will make reasonable efforts to ensure that the showreel is completed on the day. However, if your edit is not complete at the end of the day, additional chargeable editing time can be scheduled subject to availability. Spotlight will securely store the master copy of the showreel should you require future access to it. Chargeable additions and re-edits are available subject to availability.

SPOTLIGHT SHOP TERMS & CONDITIONS

These terms and conditions set out the conditions relating to purchases available via the Spotlight website.

Nothing in this statement is intended to limit any rights you have under the applicable area of consumer, or local, law.

Any purchases made through this website will be with Spotlight, whose registered office is 7 Leicester Place, London WC2H 7RJ.

Payment

Spotlight must receive payment of the whole of the price for the goods that you order before your order can be accepted.

You will be charged in the currency as indicated at the checkout phase which, if not the country of your bank account, will be converted by your bank into the currency of your bank account, when processed. We are not responsible for any additional fees your own bank may charge.

We accept Visa / MasterCard / Maestro (Switch). You can also pay by cheque via our offices if you would prefer (please call for details).

Should we find that you have been over-charged then we will refund to the card on which the order was placed. If you believe that you have been over-charged then please contact our Accounts team via our switchboard

Once you have submitted your payment details your order will automatically proceed, and we will not be able to stop the payment going through at this stage. Should you have any concerns regarding a payment that has been sent through for processing please contact our Accounts team during office hours (10.00 am to 5.30 pm) via our switchboard 0207437 7631.

Orders outside the UK

If you are ordering goods for delivery outside the EU, please note that your consignment may be subject to import duties and tax, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by the purchaser. It is accepted by you that Spotlight has no control over these additional charges and no responsibility to pay them. We recommend that you gain full information on this area before placing your order.

Tracking Orders

If your books have not arrived within the quoted delivery time, or your website access has not been established within 24 hrs (weekdays only), you can contact us Monday to Friday between 10.00am and 5.30pm via sales@spotlight.com or via 020 7440 5026 to track the progress of your order.

Liability

If the product you have ordered is no longer available Spotlight will notify you as soon as possible, and any sum debited by us from your credit or debit card will be re-credited to your account. Spotlight will not be obliged to offer any other replacement or compensation in the event of this happening.

If the goods we deliver are not what you ordered, or are damaged or defective, then Spotlight shall have no liability unless you notify us of the problem, via email to sales@spotlight.com, within 10 working days of the delivery of the goods in question.

If you do not receive goods ordered by you within 30 days of the date on which they were despatched to you, Spotlight shall have no liability unless you notify us, via email to sales@spotlight.com, within 40 days of the date on which the goods were despatched to you.

If you do notify us then our only obligation will be to make good any shortage or non-delivery; to replace or repair any goods that are damaged or defective; or to refund the amount paid by you for the goods in question. Spotlight will not be liable to pay any further related compensation.

Spotlight is entitled to withdraw from any purchase agreement in the case of obvious errors or inaccuracies regarding the goods or services appearing on our website. If an error or inaccuracy is discovered with regard to the advertised price of the goods that you have ordered, we will contact you as soon as possible. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Website Security

We take all reasonable precautions to the keep customer website transactions secure. Secure card processing is carried out by Sage Pay on our behalf (www.sagepay.com).

Spotlight cannot be held liable for any losses caused as a result of unauthorised access to the information provided by you.

We also have strict security procedures regarding the storage and disclosure of information (see our Privacy Policy).

We recommend that when making an online transaction you do not use a public or shared computer or use a device such as a laptop or cell phone while you are using public wireless networks.

The security of information and payments transmitted via the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part be borne by Spotlight.

Contacts Handbook

We are generally unable to amend an order for Contacts once it has been submitted due to the fast turnaround of the delivery process, therefore please check all details carefully before submitting. Should you have made an error or wish to cancel a book purchase once completed then please contact our Sales department (sales@spotlight.com; 020-7440 5026) for further assistance and we will help you whenever possible. However, we are unable to provide a refund when a product has already been despatched, other than for exceptional circumstances, or if the book is damaged or the wrong product is delivered.

We will deliver to the address you provide when you place your order. Should the delivery address be different then please ensure that you make this clear.

Standalone Casting Directories

We are generally unable to amend an order for a standalone directory once it has been submitted due to the turnaround of the delivery process. Should you have made an error or wish to cancel a standalone book then please contact our Sales department (sales@spotlight.com; 020-7440 5026), for further assistance and we will help you whenever possible. However, we are unable to provide a refund (for chargeable books) when a product has already been despatched.

Spotlight supplies its standalone directories to vetted industry members only. We do not offer these books for third party re-sale. For this reason we reserve the right to place restrictions on ordering, and may contact you to discuss any large orders placed via the website.

We will deliver to the address you provide when you place your order. Should the delivery address be different then please ensure that you make this clear.

Website Subscription: Subscription Periods

Our website subscriptions have different duration periods. Therefore you should check the type of access you are purchasing, associated costs and also the period of access before submitting your order.

The price for your subscription model will be confirmed at checkout before your order goes through.

Website Subscription: What is included with your website subscription?

Those placing orders for 2 year (730 days from order authorisation) or 1 year (365 days from order authorisation) subscriptions will have full access to our internet site search facilities for that period, and will also be eligible to receive a full set of our Spotlight directories (where stocks allow), at no additional charge (where inside the UK), during the course of the subscription (1 set per year for our two year subscribers).

Those placing an order for a 3 month subscription (90 days from order authorisation) will have full access to our internet site search facilities for that period, and will also be eligible to receive our Presenter, Dancer, Stunt Performer, Children and Graduates books (where stocks allow), at no additional charge (where inside the UK), during the course of the subscription.

Those placing an order for a one month subscription (30 days from order authorisation) will have access to our full internet site search facilities for that period.

Website Subscription: The Spotlight Link

Those with a website subscription will also be eligible to send casting breakdowns to agents and performers across our casting service, The Spotlight Link. Continued use of The Spotlight Link is dependent on the professional validity of casting information being sent across the system. We reserve the right to end access to The Spotlight Link at any time, and without warning, should we believe misuse has taken place, or if we receive complaints related to inappropriate information being sent out to agents and performers (this could include any material that does not meet our professional standards, or is defamatory, offensive, obscene or of a threatening nature).

Website Subscription: Single user restriction

If you are a registered user or subscriber, or have a temporary access password, you cannot share your user details with anyone else. A subscription is for one person's use. Sharing a password may mean someone accessing the Spotlight website that is not eligible to do so. Password sharing is a breach of our terms and conditions.

Should you work for a company wishing to gain multi-user access to the Spotlight website please contact our Sales team for further advice and information about current offers.

Website Subscription: Subscription Notification

We attempt to process all web subscription orders within four hours of receipt during office hours (our office hours: Monday - Friday 10.00- 5.30). However, this may not always be possible, although all orders would normally be processed within 24 hrs on a normal working day.

Website Subscription: Cancellations & refunds

You may not cancel this order once payment has been taken and you have been given full access to view the data on the Spotlight website. However, we will consider cancellations where access to our website data has not yet been provided.

Standalone Books & Website Subscriptions: Placing an order and our acceptance

Once you have completed your company/individual information you will proceed to a checkout screen. After you submit your subscription application our online payment provider will process your payment automatically. This does not represent acceptance of your order by us. Your professional credentials will subsequently be verified and we reserve the right to refuse your order within 5 days and refund your purchase costs (see 'Right to refuse access' section below).

Standalone Books & Website Subscriptions: Right to refuse access

We reserve the right to refund your money and deny access to the website or withhold standalone books:

  1. If we are unable to verify your professional credentials. Only vetted industry professionals may have access to the full Spotlight website.
  2. If we find after website access has been approved that a subscription was obtained by false information being provided then we reserve the right to end all access to our website, to protect our advertiser details. We would contact you prior to this happening to discuss the situation. We may also end access where we find that the site has been used for any fraudulent or criminal activity.
  3. In the event of obvious inaccuracies in prices, except that we may fulfil your order at the correct price.
  4. If we are unable to obtain payment authorisation from the issuer of your payment card.

Spotlight Gift Vouchers

Gift Vouchers may be used as full or part payment by the named holder against eligible Spotlight products or services. The voucher itself has no cash value. They cannot be used to purchase alternative Gift Vouchers or to claim retrospective refunds, nor can they be exchanged for cash. They are non-transferable and can only be redeemed by the individual whose name appears on them. Gift Vouchers cannot be redeemed online and expire 2 years from the date of issue. Spotlight is not responsible for any Gift Voucher lost, stolen, destroyed or used without permission. The risk of loss and title for Gift Vouchers pass to the purchaser upon delivery to Spotlight's carrier or postal service. Please return paper renewal forms with your Gift Vouchers enclosed or phone us on 020 7440 5069.
