By agreeing to these terms and conditions, you are entering into contract with Spotlight and agreeing to the lawful use of your personal data as necessary for the performance of your contract with us.
You should print and keep a copy of these terms, the Site terms and the Sales and Payment terms for your records as at the date of joining or renewing.
"Agent" means an authorised agent of a performer, who is a Member of Spotlight.
"Spotlight Casting Services" means the services made available to Casting Subscribers.
"Spotlight Casting Subscriber" means a casting professional who has signed up with Spotlight as a recipient of the Casting Services.
"Content" means the information and other material or applications available within the Site or relevant Services.
"Spotlight Member" means a performer who has signed up with Spotlight as a member of its database and recipient of the Member Services.
"Spotlight Member Services" means the services that may be made available by Spotlight to Members as detailed below and on the Site.
"Sales and Payment Terms" means the further specific terms relating to the processing of any payments.
"Site" means the sites located at spotlight.com and spotlight.com/contacts
"You" means the user of the Site(s) or the Content or otherwise the Member.
"we/us" means Spotlight.
These terms and conditions set out the conditions relating to joining Spotlight as a Member and receiving Member Services.
Spotlight Member Services
Spotlight allows you to advertise yourself as a performer. Your Spotlight membership provides you with a profile to promote yourself to industry professionals. Full Spotlight membership also provides access to The Spotlight Link. We additionally offer full Spotlight Members a range of other products and services from time to time. A Spotlight profile and access to certain other of our member services may also be provided where we have an arrangement in place with an organisation representing you. Our Membership Services are summarised below with further information available on the Site as indicated.
Your Spotlight Profile
Your Spotlight online profile and entry in any print/digital editions, where available, are considered to be promotional tools for you, and a means for you to obtain exposure to potential hirers. This is how Spotlight will, or will allow others, to make them available:
Your profile/entry - showing your professional details including name, contact(s), physical details (including general appearance), skills, credits, notes added to your web page by you, photograph(s) with photographer credit(s), showreels and voice clips - can be accessed in the following ways:
- By you/your agent (or representative) passing on access details which may be in the form of a hotlink (this could also include a direct link from your agent or representative's own website) or using it for another method as a means to promoting you.
- By a Spotlight Casting Subscriber or other industry professional, using the site or digital edition, sending on a link to your profile (for instance a casting director sending a link to the director of a production so that they can assess your suitability for a part.
- By a hirer using a link to your online profile as part of a production promotion (where agreed with you).
- By Spotlight Casting Subscribers and their invited team members and clients as part of the Spotlight Casting tools.
- Where other formats are offered by Spotlight at time of joining or renewal.
- By you or your agent, or a hirer, copying your information or otherwise linking to it or accessing it from Spotlight approved third party project or workflow management systems.
Please note: As many of our Services are primarily promotional tools personal data included in these public profiles may be accessible by other Spotlight users and/or the public via wide circulation or redistribution, and via our historical archives. Therefore you should never include any personal data on your profile that you would wish to remain private.
The Spotlight Link
The Spotlight Link is a system allowing industry professionals who are Spotlight Casting Subscribers to send out casting breakdowns to Agents and Spotlight Members. Full membership of Spotlight will include defined levels of access to The Spotlight Link.
Spotlight does not have access to the casting briefs prior to them being sent out, and cannot take responsibility for information included in them. Spotlight does however apprise our Spotlight Casting Subscribers of their responsibilities in line with related legislation. Should you have any concerns regarding the nature of a casting brief sent out to you then please use the 'Report Concern' button available on the website or contact our offices immediately to report this.
If you are listed as c/o Spotlight then we will contact you to pass on messages from industry professionals, if they contact us trying to reach you. It will then be your decision if you wish to respond to them directly to discuss their project. We will try and contact you but cannot take responsibility for you missing out on work opportunities if we have been unable to reach you within the required time frame.
Please note: Spotlight is not an employment agency. It does not become involved in the casting process and cannot act on your behalf in any work related negotiations; we will only pass on messages from potential employers. For more information see below under Spotlight status.
Also, Spotlight only provides the functionality of The Spotlight Link and other services. It is not responsible for the content of the job adverts, including opportunities, or the actions of the advertiser or subsequent employer.
Spotlight Casting is an end-to-end casting service for the professional casting industry, providing tools and facilities for streamlining the casting process. Spotlight members' online profiles, photography and media will be accessible to all collaborative professional casting teams using the service.
Spotlight Member Criteria
Please note that each Spotlight membership category will have its own vetting criteria for membership. For instance, our adult performer membership is only open to professionally trained or experienced performers. Your membership may be refused based on the criteria set in each case, in which case you will be notified and a full refund (if applicable) will be supplied.
Your Professional Name
We recommend that every Spotlight Member uses one unique, professional name across the industry, to avoid confusion with another Spotlight Member. We reserve the right to refuse membership or withhold a name change request if your name is not sufficiently different from another Spotlight Member, or for any other reason related to our terms of service. You may be asked to change your name if it is already being used, or a refund will be given for your membership. Please see https://www.spotlight.com/help-and-faqs/your-spotlight-name-and-faqs for further information and ideas on how to change your name if it clashes with another Spotlight Member.
Please be aware that acceptance of a name by Spotlight does not guarantee that the performer's use of the name will not result in trade mark infringement actions, or actions for passing off, or other actions by other parties, and that it is the performer's sole responsibility to deal with any such claim. Spotlight will not be able to intervene in disputes between performers/agents regarding name registrations on Spotlight, whether this be in relation to trademarked names or otherwise. In such instances, complainants would need to seek contact with the other party.
Professional information you supply
You promise that all information provided by you is truthful, honest and accurate. Spotlight reserves the right to edit the information you supply, if it is more than sufficient for suitable display, or to amend or refuse or substitute any information tendered if Spotlight reasonably considers it unsuitable or inconsistent with the general standard, appearance or policy of Spotlight.
Content and clearances - Uploading photos, video and audio clips
It is the responsibility of the Spotlight Member and/or their agent(s) managing their accounts to ensure that they have full copyright clearance for all photography, voice clips, showreels and any other content featured as part of their Spotlight Membership, which includes necessary permissions to edit, alter or create any content using any tools, including those available on the platform. This must be cleared for all uses set out in these terms and conditions, including the technical, development and research purposes set out below.
It is also the responsibility of the Spotlight Member to ensure they have clearance to list details of productions/projects they have been involved in, or will be involved in, without disclosing confidential information which may cause harm to the hiring company concerned.
You must not upload material that is unlawful, defamatory, abusive, obscene, discriminatory or otherwise inappropriate.
Spotlight reserves the right to suspend or withdraw services from Spotlight Members who violate our terms and conditions, and not to use or make available any material which it deems inappropriate, or to remove material which it considers to be in breach of these terms and conditions.
If there is any sort of dispute, Spotlight will take your material offline until you clear the right to use the material.
Photographs - further notes
You must provide us with the name of the photographer for all photographs submitted to Spotlight. Photographers must be credited, according to copyright law. We reserve the right to refuse any photograph which we consider unsuitable or inappropriate. If other parties are identifiable in photographs, you must have the explicit consent of those parties
Showreels and voice clips - further notes
Copyright is a legal right which exists in literary, dramatic, artistic and musical works. If you are taking a clip from previous professional work, in most cases the producers of that work will either have rights assigned to them or at least, a licence to the rights. Producers normally grant permission for you to use short clips completely free of charge - but you must check with them first and get their permission in writing.
If you are linking to an existing clip or recording a clip from scratch especially for your showreel/ voice clips, remember that most 20th century scripts are still subject to copyright, and you should seek permission from the publisher.
Spotlight Members may use the Spotlight logo on their own website as long as: it is a single instance of the Spotlight logo as a link to our website www.spotlight.com, it is in the context of a factual reference to the role of Spotlight, and the logo does not imply Spotlight's endorsement of any website or online service. Your Professional and Personal contact details
Professional contact details
Please note that Spotlight does not generally publish personal contact details (where known to us as such). If you do not have an Agent, you will generally appear in Spotlight as "c/o Spotlight", which means you may receive information from us regarding casting opportunities from third parties. You may receive information regarding such opportunities to your email or via SMS, but your personal contact details will remain anonymous unless you choose to share them by responding to a hirer via the Spotlight Link (where your email will become available) or by passing them to a potential hirer directly.
When you have an Agent, enquirers will usually contact you via your Agent. If they call our offices then they will only be given your representative's contact details. However, should a Spotlight Casting Subscriber tell us that they have been unable to reach your representative, in these instances we will leave a message for your Agent but also try to contact you directly.
Spotlight has a formal registration procedure for Agents and access will only be provided to agents where their professional background can be assessed.
If you are in a Spotlight database where you do have the option to list personal contact information, please be aware that this information could be widely circulated or shared, including in the public domain, and therefore you should never list information that you would wish to keep private.
If you have links to public resources outside of Spotlight such as personal websites or social media, you do so at your own risk.
Personal contact details
It is your responsibility to ensure that we have current valid contact information for you, at all times, so that we can contact you with information about your Spotlight Membership and in some instances so that you can receive information about casting opportunities from third parties.

Your email address
Spotlight uses email as its main method of communicating with its Spotlight Members. Information emailed to you may contain confidential information about you. It is your responsibility to keep your email address up to date with Spotlight, secure, and ensure that the relevant logins are not known by anyone else.
Owing to the nature of email and the internet, Spotlight cannot take responsibility for the successful delivery of email to your chosen email provider. Please ensure that you set up your spam filter/junk mail folder correctly to ensure that emails from Spotlight (including automated emails) can be received.
You can update your contact preferences at any time by signing onto our Site. Alternatively you can email [email protected] or send a letter to Spotlight at the usual address, for the attention of the Data Protection Officer.
Restrictions and responsibilities
The Content and/or information sent or made available via The Spotlight Link or otherwise on the Site is the confidential information and copyright of the relevant sender or provider (or of their employer). In using The Spotlight Link, you agree not to forward or copy any part of this information and that you will only use the casting breakdowns, and the information set out in them, for the purposes of suggesting yourself (as a Spotlight Member) or clients (as an Agent) for the relevant casting opportunity, by, and only by, using the link provided in the system to send proposals back to the relevant Spotlight Casting Subscriber.
All production information (including individual roles/casting breakdowns) sent by Spotlight Casting Subscribers should be treated as strictly private and confidential and details should not be released to any other parties or shared outside the Spotlight platform. Agents or Spotlight Members will be liable where they, or their employees or clients, cause damage (including financial loss) to a hirer by releasing confidential production details in advance of this information being in the public domain.
In addition please note the Scraping or Extraction - Prohibition in the Site Terms.
Notwithstanding the above prohibition, to facilitate Spotlight Members, Agents and Spotlight Casting Subscribers with their workflow management processes, or other activity, Spotlight may from time to time provide or authorise the use of certain third party software or applications to facilitate additional off Site access to the materials and Content. Such third party packages or systems are strictly subject to the written approval of Spotlight. A list of currently authorised third party packages or systems is available to Spotlight Members/Agents/Spotlight Casting Subscribers by contacting Spotlight.
Please note that Spotlight does not endorse and is not responsible for any such third party packages or systems. Any use is at your own risk and Spotlight will not be liable for any loss of information, materials, data or otherwise that may occur due to the use of your materials within them. Please contact us for further information or to discuss use of other packages or applications.
Any breach of these terms could cause inconvenience and loss to the sender or provider of information, and loss to Spotlight. Spotlight reserves the right to terminate your access to The Spotlight Link and other relevant services without notice in the event of a breach. It also reserves the right to withdraw or withhold The Spotlight Link service for individual Agents, Spotlight Members or generally, where it considers this to be commercially desirable or for any other reason it deems appropriate.
To ensure quality of service we may withhold access to The Spotlight Link and services in general from Spotlight Members whom we consider to lack the relevant credentials or professional experience.
We also reserve the right to terminate access where our staff or other persons are subject to abusive, offensive or threatening behaviour.

On becoming a Spotlight Member, your details will go into our database and be made available on our Site at the earliest opportunity. You will then be sent an automated email with an access link (to the email address provided on your application) letting you know that your Spotlight online profile is now live, and allowing you to review the details.
Young performers must be represented to join and remain with Spotlight. For young performer members details may be provided by an Agent or School (with parent/guardian consent if under 18; client consent over 18, or by a parent/guardian or client completing an application via a link provided by the Agency or School.
It is your responsibility on joining to have checked the professional name you wish to use is available, provide a suitable photograph for your application and all other required details. Failure to do so will cause delays to the upload of your details onto our Site, and could also result in your application being rejected by us if all required details or a suitable photograph have not been supplied within 10 days of your application being submitted.
If you have not received an automated email containing your access details within 10 working days of joining Spotlight then please contact us immediately.
When Performers start using Spotlight services
On joining Spotlight, Spotlight Members/Parents/Guardians will be provided with a View PIN and information on how to register and sign in to their account. A View PIN is available to both Spotlight Members/Parents/Guardians and their Agents for promotional purposes and can be shared with those you wish to view the Spotlight Member's Spotlight profile. The sign in is confidential, allowing live changes to the Spotlight Member's online profile and account administration access, and should never be shared.
Members are responsible for all activities on your account/profile and must keep sign in information secure and confidential. If sign in details are shared with an Agent or any other parties, they must be authorised and instructed appropriately, and this is done at their own risk.
You can change your View PIN after leaving an Agent, or at any time if you have security concerns by contacting the Spotlight offices via [email protected]
We understand that you may employ an Agent to manage your activity for you, or whilst undertaking training your training establishment may manage such activity. It is your (the Spotlight Member's) responsibility to ensure that, and you confirm that, any person, including your Agent or Training Establishment, who accesses your account/profile, or takes actions on your behalf, whether using your sign in, or otherwise, is fully authorised by you, and is entitled to take actions on your behalf and to contractually bind you.
Spotlight Performance Calendar
The Spotlight Performance Calendar enables Spotlight-approved schools to promote their students' performances and showcases to agents and casting professionals. Information published via the calendar is publicly available and includes times and dates, venue details and maps, and may include personal information such as a performer name, which can be linked to a performer's public profile. Information must only be submitted where the user has the consent from the educational establishment to use the system. Personal information must only be submitted where students have authorised their education establishment to administer their profile for promotional purposes. Where the performer is under the age of 16, the parent or guardian's consent must be gained.
The following additional services will be available to you on joining Spotlight, as summarised below and subject to any further guidelines, policies and prices specified here or on the Site.
Photograph, Video or Voice clip Upload
Spotlight Members/Agents can add new photographs and video to their online profiles at any time by signing into the site.
Media storage services will be withdrawn upon expiry or withdrawal of an individual's Spotlight Membership(s).
Spotlight reserves the right to delete all or some of a Member's media on expiry of their Spotlight Membership(s) or for any other reason, including, but not limited to, withdrawal of media upload services for whatever reason.
Spotlight does not offer its Spotlight Members the ability to download or otherwise recover media files in their original quality or format. Spotlight therefore strongly recommends that Spotlight Members retain their original media files. Furthermore Spotlight cannot be held responsible for loss or corruption of data, including accidental or intentional deletion by either party.
Spotlight Studio Services
Spotlight Actor On Tape
"Actor on Tape" allows you to use our state-of-the-art casting studios, at short notice, to record and share casting clips. Current information, prices and our cancellation policy can be found using the following link: http://www.spotlight.com/artists/SpotlightActorOnTape.html.
This service provides the opportunity to spend 1 to 3 hours with one of our professional editors turning video material into a showreel. Our studios can be used to record a 2 minute scene of your choice for inclusion on your Spotlight profile as part of your showreel. Get in touch with us at [email protected] to find out more.
Spotlight Discounts is free to our members and gives you access to a huge variety of consumer savings, letting you make savings on everyday purchases. To access Spotlight Discounts simply sign into your home page and click on the Spotlight Discounts button. Please note that Spotlight Discounts is provided by Parliament Hill (third party) and Spotlight is not responsible for these third party offers.
Spotlight Membership fees/payment
Your Spotlight Membership is renewed by way of an annual membership fee, except in relation to the Additional Services where it is charged in accordance with the Additional Services section above.
Brand new Spotlight members (those who have not been in Spotlight before) joining Spotlight may cancel their Spotlight membership at any time within 30 days of our acceptance of your application with you having agreed to these terms and conditions, without incurring any fee or penalty (no payment fee will be cashed or debited for any aspect of your membership during this period, although for certain membership groups your card may be pre-authorised, which creates a hold on your card until payment is taken or the transaction cancelled). No refund is available on an annual Spotlight membership after this period.
The cooling off period - up to 30 days - can only be completed in one block. New Spotlight Members having completed one cooling off period would not be eligible for another.
Submission of your application amounts to an offer by you to purchase a Spotlight Membership, and is subject to our acceptance. Your Spotlight Membership starts on our acceptance of your application.

Payment by Direct Debit
You can also pay your annual membership fee by annual or monthly Direct Debit.
Once your Direct Debit is set up it enables you to automatically pay your membership fee each year, or by month, until you cancel your Direct Debit. Your contract is for a year's membership, even if you are paying by monthly Direct Debit.
When you sign up for Direct Debit payments you will receive an email confirmation of your Direct Debit, incorporating your advance notice and key information such as your payment terms. Thereafter we will contact you up to 30 days in advance of each annual membership renewal to remind you when the next payment will be taken and to notify you of any changes to the membership fees and Direct Debit amount. The subsequent annual membership fees will begin on each 12 month anniversary of your joining or renewal date. We will send you email confirmation of the new period, fees and payment dates.
If you do not wish to continue paying by Direct Debit, you must contact your bank about the Direct Debit, and also Spotlight to arrange for an alternative payment method. Please note, this will not automatically cancel your membership, which will continue until cancelled with Spotlight in accordance with the Membership Terms and Conditions.
Direct Debit instructions established on or after 28th June 2021 are managed by GoCardless. You can view their terms here: https://gocardless.com/legal/.
All mandates created before 28th June 2021 will be managed by GoCardless from the 1st July 2021.
If you are paying by monthly instalments and wish to stop paying by Direct Debit using the bank account you specified at the start of that year's membership contract before all instalments have been paid, you will need to settle in full by debit or credit card (we do not take American Express or Diners Club) the total of the remaining instalments of your annual membership. You will need to make this payment by the time your next instalment would have been due to avoid disruption to your Spotlight services. For clarification, we are currently unable to set up new Direct Debit mandates part way through an annual membership contract.
Missed Direct Debit payments and outstanding fees
If we are unable to collect your Direct Debit on the due date, we will attempt collection a second time. You will receive an email to explain this. If we fail to collect your payment on our second attempt, your Spotlight services will be put on hold (suspended) or cancelled, depending on the circumstances, and you will receive an email setting out the options open to you. We may contact you via other communication channels, such as by phone, in order to pursue any amounts due. Whilst on hold (suspended), your annual contract will continue to run until its original end date, even if your services have been put on hold due to non-payment of monthly instalment(s); your membership end date will not be extended to compensate you for any time your services were on hold.
Missed payments for a membership on hold must be made good within 14 calendar days from the date services were suspended. Failure to do so will result in your membership being expired early and you being considered as a defaulting member. You may reactivate your Spotlight membership at any time after the expiry of your membership; however, a member who has previously defaulted on a monthly instalment will not be offered a monthly payment option until two years of membership, paid annually in advance by debit or credit card, have passed.
Spotlight reserves the right to remove, for any reason whatsoever and at any time, the ability for a member to choose to pay by monthly instalments.
It is important that you keep your email address for Direct Debit communications up to date.
We reserve the right to make price changes to future membership fees. This will not affect your current annual membership fees but future fees may increase. We will always notify you of any changes in fees in advance your membership renewal.
Cancellations and Refunds
Spotlight cancelling membership
Spotlight reserves the right to refuse or cancel membership/services for any Spotlight member, agent, casting subscriber or casting invitee without explanation. In the event that membership or subscription is cancelled or refused at will by Spotlight, a full refund will be given.
We additionally reserve the right to terminate Spotlight memberships, subscriptions and accounts temporarily or permanently where our staff or other persons are subject to abusive, offensive or threatening behaviour; where information supplied cannot be validated; where there are fraudulent applications or activities (or where there is legitimate suspicion of same); where the vetting/joining criteria is no longer met; where Spotlight has received multiple complaints about an individual or associated company which are investigated and upheld (of which the individual/company would not be privy to); where having the person/company on the platform would be detrimental to other person(s)/company(s) using the Spotlight platform; and where we may see information about a person/company in the public domain which suggests having them on our platform may cause reputational damage to Spotlight or be detrimental to other person(s)/company(s) using the Spotlight platform. Please note that we cannot always act on complaints received or information that becomes known.
Members cancelling Spotlight membership
You will be contacted each year to confirm that you wish your Spotlight Membership to continue. Should you decide to terminate your Spotlight Membership then your profile will still be available for the duration of time quoted at your last membership renewal. Should your Spotlight Membership lapse, we may endeavour to offer you another chance to re-join and will retain the necessary amount of personal and professional data in order to meet this purpose. We do not guarantee to make these follow-up offers.
If you contact us and ask to cancel with immediate effect we will then remove your online profile (including any multimedia attached) immediately. As per the payment terms, you would not be eligible for a refund in these circumstances.
When a Spotlight Member cancels their membership we retain their contact details in our internal database in line with our retention policy for reference purposes, for the following reasons:
- For beneficial professional enquiries (former Agents/Hirers trying to contact you via Spotlight with outstanding payments, etc.) in which case we may attempt to contact you to pass on a message.
- Some details are also retained so that when you next re-join Spotlight you are recognised as an approved former Spotlight Member and your online profile can be activated as quickly as possible.
- To ascertain the previous membership status of those applying for future Spotlight Membership, in order to administer cooling off periods and similar where required.
However, once you are no longer a Member no new casting enquiries would be forwarded.
Please note: The message forwarding mentioned above for former Members does not form part of your Spotlight membership and is not guaranteed. Spotlight reserves the right to archive and delete old Spotlight Member records to control the accuracy of the data held on our system, in line with Data Protection Legislation.
In the event of the death of a member, the estate can inform Spotlight of this by contacting [email protected] The estate may be required to provide a copy (not an original) of the death certificate which will be deleted as soon as it has been reviewed and verified. Once this has been verified, Spotlight will take appropriate actions in terms of administering the deceased member's profile and account.
If the deceased member's Spotlight membership was paid by card, cheque or annual direct debit, the estate may be entitled to receive a refund of unexpired whole months of the year's membership from the date of death. If the membership was paid by monthly direct debit then payments to Spotlight will automatically be stopped when the deceased's bank become aware of the death from the estate.
Disclaimers and Liability
Spotlight's database contains information about Spotlight Members (performers) which is provided by the performing artists themselves, or their Agents.
Those employing Spotlight Members (performers) or specialists must make their own enquiries of the Spotlight Member (performer)/specialist to satisfy themselves that they are competent to perform the skills required.
Notwithstanding that appropriate steps have been taken to ensure that the information we publish is accurate, Spotlight (and those organisations on whose behalf we publish) cannot be held responsible for any errors or omissions, and cannot accept liability for reliance placed on the contents and/or any omissions which may occur.
Due to the inherent nature of the internet, and other technology systems we use, errors interruptions and delays may occur in the Service at any time. Accordingly, the Site and Services are provided without any warranties of any kind and we do not accept any liability arising from any inaccuracy or omission in the information or interruption in availability.
Spotlight, whilst using every endeavour to reproduce information punctually on the dates announced, is not to be liable for any delay.
Spotlight asks for full information for those seeking a Spotlight Casting Subscription, and only allows this to be purchased where we are happy that the Spotlight Casting Subscriber can offer our Spotlight Members valid professional work opportunities. However, Spotlight cannot take responsibility where false information may have been provided, and this is why we ask our Spotlight Members never to list personal/sensitive information on their profile.
Spotlight only provides the functionality of The Spotlight Link and other services. It is not responsible for the content of the job adverts or the actions of the casting professionals or any subsequent employer.
Because of the promotional nature of your online profile, Spotlight cannot control its circulation by those parties mentioned above. We also cannot control disposal or re-distribution of our online/printed/digital products.

Spotlight does not endorse and is not responsible for any third party packages or systems that help manage information or workflow, even if approved by Spotlight. Spotlight will not be liable for any consequences arising from the use of such packages or systems.
To the maximum extent permitted by applicable law, we exclude all liability for any indirect, special, consequential or punitive damages, or any loss of income, profits, goodwill, data or contracts arising from or connected in any way to your use of the Services or Site your reliance on the Content, whether in tort (including without limitation negligence), contract or otherwise, even if advised of the possibility of such damages.
To the extent there is any liability on us, this is limited at a maximum amount per claim and in aggregate to the annual amount paid by you for the relevant Service.
This section does not in any way limit our liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; or for any implied terms or other matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
Should you believe that your Spotlight online profile is being linked, without your consent, to any other publicly available area, by an individual or organisation, other than your Agent or representative, please inform us via [email protected] or [email protected]
If you have security concerns at any time we can:
- Change your Spotlight View PIN and sign-in (both of these would need to be changed for security reasons), or
- Change your Spotlight reference number appearing on your web page URL (this would mean all your data being re-entered into the Spotlight database, and the automated creation of new View PIN and sign in).
We take all reasonable precautions to keep website interactions secure. We also have strict security procedures regarding the storage and disclosure of information. However, Spotlight cannot be held liable for any losses caused as a result of unauthorised access to the information provided by you.
The security of information transmitted via the internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part be borne by Spotlight.
Security advice note: We recommend that when conducting an online operation you do not use a public or shared computer or a device such as a laptop or mobile phone while you are using public wireless networks. Make sure that nobody can see your confidential details whilst you are typing, logout and close your browser when you have finished. The computer you use to attach to our system should be secure, and include the latest operating system, software and anti-virus updates.
Status and role of Spotlight
Spotlight is not an employment agency, and Spotlight never takes commission on work opportunities found for or by its Spotlight Members. It does not become involved in the casting process and cannot act on your behalf in any work related negotiations; we will only pass on messages from potential employers. Spotlight does not have access to any arrangements between worker and hirer relating to meeting or working venues, and other terms of employment; therefore Spotlight Members or their representatives should use due diligence in reviewing their safety arrangements and the terms of any contract supplied by a hirer. Spotlight will not accept fees for work on behalf of any Member; all payments for work must be arranged between the worker and the hirer, or their official representative.
Spotlight cannot guarantee you work, and your membership does not constitute an offer of jobs to you and is not part of the Spotlight Member Services. The decision to offer you work rests with professionals using the platform, and is impacted by a number of industry factors. Spotlight has no involvement or influence in these decisions.
Spotlight is not involved in compiling the job adverts which appear on The Spotlight Link. Spotlight is committed to equal opportunities for all performers, irrespective of sex, age, race, disability, religion, sexual orientation, marital status or any other criteria not related to skills or abilities. Where sex, age, height and/or appearance have been specified on an advert, the casting director has confirmed that such characteristics are a genuine occupational requirement of the role.
NATIONAL MINIMUM WAGE
Spotlight strongly believes that all commercial productions should pay performers the National Minimum Wage or above. However, we cannot take responsibility for the payment offered by any company, organisation or individual using our casting services. Please see Equity's current guidance for full information about the legal framework which covers low pay and no pay work in the entertainment industry, to ensure that you understand your rights and entitlements.
Research into improved technology and developing new functionality
We are constantly looking for new ways to change and upgrade our services and the functionality that we can provide to you, including through the use of the latest technology. This may involve partnering with selected and trusted research organisations and technology providers to contribute to their research and innovation projects. Often the most innovative developments come from other industries or fields of research outside of our own, and the outputs of the research may have a broader application beyond the improvements from which we directly benefit.
As part of this research and to develop these improvements, our trusted partners may be given access to our systems and data and/or be provided with copies of our data, including Member photos, video and audio clips, and other professional information. You acknowledge this disclosure of your professional information for the above purposes.
In all such circumstances our partners' access to and use of this information will be strictly limited to specific research projects that may benefit Spotlight and our services to you, and will be under secure, confidential, temporary conditions and closed testing environments. Under no circumstances will this information be used for any commercial or live operational activity, other than to develop and test the specific technology and functionality, without your explicit prior consent. Your personal information and contact details will never be disclosed or used in this way.
If you breach these terms we may suffer loss. You agree to indemnify us against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of any non-compliance by you with these terms and conditions.
These terms and conditions (as amended from time to time) together with any document expressly referred to in them comprise the entire agreement between you and us.
Each provision of these terms and conditions shall be construed separately, applying and surviving even if for any reason one or other provisions is held to be inapplicable or unenforceable in any circumstances.
No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.
These terms and conditions shall be governed by English law and you submit to the exclusive jurisdiction of the English Courts.
