Use of Spotlight

By using the Spotlight Site(s) and services, you agree to the terms and conditions below, which are subject to change. Please also read our Privacy Policy.

Services available

Spotlight makes certain Services available through the Site. These may be subject to certain eligibility criteria. You will be required to agree further contractual terms before receiving such Services. In the event of any conflict, these terms will take precedence.

You should print and keep a copy of these terms for your records as at the date of joining or renewing.

Privacy and personal data

Spotlight is committed to protecting the privacy of users of its Sites and Services. Our Privacy Policy sets out the type of information that we collect, what it is used for and the rights you have in relation to this information. By using this Site and signing up to any Services, you accept the terms of this Privacy Policy.

As many of our Services are primarily promotional tools, personal data included in these public profiles may be accessible by other Spotlight users and/or the public via wide circulation or redistribution, and via our historical archives. Therefore you should never include any personal data on a profile that you would wish to remain private.

Safeguarding

Spotlight recognises that the protection of children is of paramount importance. By using the site, you agree to abide by our Safeguarding Policy.

Changes to these terms and conditions

We reserve the right to change these terms and conditions and our service terms and privacy policy from time to time. Continuing to use the Site following any changes will mean that you accept and agree to the modified Terms. Where practical we will notify you of changes to these terms and conditions and prompt you to review these. However, it is your responsibility to regularly check our terms and conditions and privacy policy. If you do not agree to any changes made to them you must immediately stop using the Site.

Intellectual property

You acknowledge that all copyright, trademarks and all other intellectual property rights in the Sites and Content belongs to and shall remain vested in us, our licensors or contributors.

Rights granted/rights reserved

The Site, Content (and associated ideas and information) and Services, and associated rights and permissions, are provided strictly in accordance with these and the Services terms and conditions only.

Use of the Site

In addition to and not withstanding any restrictions noted above, you agree:

  1. Not to use the Content or Services for any unlawful purpose;
  2. Not to make any use of or interfere with the Site or Services such that the whole or part of the Site is interrupted, damaged, rendered less efficient, or the effectiveness or functionality of the Site is in any way impaired;
  3. Not to use the Site or Services for the transmission or posting of any viruses or any material which is defamatory, offensive or of an obscene or menacing character, or in such a way as to cause annoyance, inconvenience or needless anxiety; 
  4. Not to use a link to or content from a Spotlight Member’s online profile on any publicly accessible website or otherwise without their express permission. You also agree to remove any link to or content from a Spotlight Member’s online profile on request;
  5. Not to use a link to or content or information from casting details accessed via Spotlight on any publicly accessible website or otherwise without express permission of the Spotlight Casting Subscriber or their employer.
  6. You also agree to remove any link to or content or information from casting details on request;
  7. Not to (nor to facilitate any third party to) copy, transmit, distribute, publish, commercially exploit or create derivative works of the Site or Content (and associated ideas and information), or the Spotlight name or Logo, without prior written permission from Spotlight;
  8. Not to (nor to facilitate any third party to) bulk copy, disseminate, publish, reproduce, modify, transfer, commercially exploit or create derivative works of the Site or Content and associated ideas and information, including as part of the creation of, or Content of, any website, database, publication, information service or bulk mail transmission service (this would include not transferring materials supplied where permission is provided on the site to download content);
  9. Not to infringe the legal rights of Spotlight or any party featured on the Site or otherwise when using the Service; including those rights relating to Intellectual Property, Data Protection, Electronic Communications, Copyright or any other applicable rights or laws;
  10. Not to misrepresent when using the Service, by using the name or details of another party or by submitting materials for a party without their consent;
  11. Not to use the Spotlight logo, name, brand or materials to imply or attempt to imply any endorsement or other association of any product or company for any purpose.

We reserve the right to take appropriate action to prevent any contravention of the above and or any other contravention of Spotlight's terms.

Scraping or Extraction - Prohibition

In addition to and not withstanding any restrictions noted above, the extraction, copying or reuse of any content, information or data from the Site by any automated system, software, manual process or otherwise, for use in other sites, applications or systems is strictly prohibited. You shall not engage in such acts or activity, nor authorise or facilitate others in relation to the same without our express written permission which will be subject to further written terms.

No Warranty

The Site and the Content (which includes Content that is supplied to us by third parties either directly or indirectly) is provided on an "as is" and "as available" basis and we make no warranties or representations, whether express or implied, in relation to the Site or the Content, including but not limited to, implied warranties or conditions or completeness, accuracy, satisfactory quality and fitness for a particular purpose.

Use of the Spotlight logo

Spotlight Members and Subscribers may use the Spotlight logo on their own website as long as: it is a single instance of the Spotlight logo as a link to our website www.spotlight.com, it is in the context of a factual reference to the role of Spotlight, and the logo does not imply Spotlight's endorsement of any website or online service. 

Liabilities and Disclaimers

To the maximum extent permitted by applicable law, we exclude all liability for any indirect, special, consequential or punitive damages, or any loss of income, profits, goodwill, data or contracts arising from or connected in any way to your use of the Services or Site and your reliance on the Content, whether in tort (including without limitation negligence), contract or otherwise, even if advised of the possibility of such damages.

Nothing in these terms and conditions limits any liability which cannot legally be limited under applicable law.

To the extent there is any liability on us, this is limited at a maximum amount per claim and in aggregate to the annual amount paid by you for the relevant Service.

This section does not in any way limit our liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; or for any implied terms or other matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

Spotlight shall additionally be under no liability if it is unable to carry out any provision of Service for any reason beyond its control; including, but not limited to, storms, fires, floods or other forces of nature or due to legislative requirements/changes, war(s) or employee/supplier employment disputes.

You agree that Spotlight shall not be liable for any loss or damage whatsoever arising directly or indirectly from or in any way connected with the Site or your use of or reliance upon the Content or any information you obtain by means of the Site, or any bookings or purchases you make from third parties through your use of the Site, including, without limitation, damage for loss of profits, loss of business, or any other consequential or pecuniary loss (even where we have been advised of the possibility of such loss or damage).

Availability of the Site

You acknowledge that faults may lead to temporary unavailability of the Site and related Services; and that the operation of the Site and related Services may be adversely affected by conditions and performances outside our control, including, without limitation, transmission and telecommunications links between us and you and between us and other systems and networks. Accordingly, the Site and Services are provided "as is" and we do not accept any liability arising from any non-availability or interruption in availability.

Due to the inherent nature of the internet, and other technology systems we use, errors, interruptions, and delays may occur in the Service at any time. Accordingly, the Site and Services are provided without any warranties of any kind and we do not accept any liability arising from any inaccuracy or omission in the information or interruption in availability.

Links to other sites

We may provide links to other websites on our website or during other communications (for instance, booking services or software providers). You acknowledge and agree that we are not responsible for the availability of such external sites, and do not endorse and are not responsible or liable for any content, advertising, products, services or other materials on or available from such sites, nor for any issues encountered through your use of such services.

Forwarding enquiries to Spotlight Members

Spotlight offers an enquiries (forwarding) service for its Spotlight Members which is for professional casting / agent messages only. No other messages or information will be forwarded to Spotlight Members. Spotlight reserves the right not to forward any material it deems inappropriate or offensive.

Errors and Omissions

Notwithstanding that appropriate steps have been taken to ensure that the information we publish is accurate, Spotlight (and those organisations on whose behalf we publish) cannot be held responsible for any errors or omissions, and cannot accept liability for reliance placed on the contents and/or any omissions which may occur.

Delays

Spotlight, whilst using every endeavour to reproduce information punctually on the dates announced, is not to be liable for any delay.

General Terms

Website Security

We take all reasonable precautions to keep website interactions secure. We also have strict security procedures regarding the storage and disclosure of information. However, Spotlight cannot be held liable for any losses caused as a result of unauthorised access to the information provided by you.

The security of information transmitted via the internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of email or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part be borne by Spotlight. 

Status and role of Spotlight

Spotlight is not an employment agency, and Spotlight never takes commission on work opportunities found for or by its Spotlight Members. It does not become involved in the casting process and cannot act on your behalf in any work related negotiations; we will only pass on messages from potential employers. Spotlight does not have access to any arrangements between worker and hirer relating to meeting or working venues, and other terms of employment; therefore Spotlight Members and/or their representatives should use due diligence in reviewing their safety arrangements and the terms of any contract supplied by a hirer. Spotlight will not accept fees for work on behalf of any Member; all payments for work must be arranged between the worker and the hirer, or their official representative.

Spotlight cannot guarantee you work, and your membership does not constitute an offer of jobs to you and is not part of the Spotlight Member Services. The decision to offer you work rests with the hirers using the platform, and is impacted by a number of industry factors. Spotlight has no involvement or influence in these decisions.

Equal Opportunities

Spotlight is not involved in compiling the job adverts which appear on the Jobs Feed. Spotlight is committed to equal opportunities for all performers, irrespective of sex, age, race, disability, religion, sexual orientation, marital status or any other criteria not related to skills or abilities. Where sex, age, height and/or appearance have been specified on an advert, the casting director has confirmed that such characteristics are a genuine occupational requirement of the role.

National Minimum Wage

Spotlight strongly believes that all commercial productions should pay performers the National Minimum Wage or above. However, we cannot take responsibility for the payment offered by any company, organisation or individual using our casting services. Please see Equity's current guidance for full information about the legal framework which covers low pay and no pay work in the entertainment industry, to ensure that you understand your rights and entitlements.

Children and Young Performers

A child under school leaving age may need a licence if they take part in certain events. For further information please see our FAQs or visit the Government website  Please ensure that Young Performers are appropriately licensed.

Children are not permitted to create accounts, maintain profiles or access Spotlight Services. Only Agents, parents or legal guardians of performers who are under 18 years old may register the respective Young Performer for Membership, create and maintain profiles and resumes, and utilise the Services on their behalf. 

Indemnity

If you breach these terms and conditions, we may suffer loss. You agree to indemnify us against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of any non-compliance by you with these terms and conditions.

Entire agreement

These terms and conditions (as amended from time to time) together with any document expressly referred to in them comprise the entire agreement between you and us.

Severability

Each provision of these terms and conditions shall be construed separately, applying and surviving even if for any reason one or other provisions is held to be inapplicable or unenforceable in any circumstances.

No waiver

No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

Legal jurisdiction

These terms and conditions shall be governed by English law and you submit to the exclusive jurisdiction of the English Courts.

Membership and subscription terms

By agreeing to these terms and conditions in the purchase or obtaining of a membership or subscription, you are entering into a contract with Spotlight and agreeing to the lawful use of your data as necessary for the performance of your contract with us.

Using Spotlight’s services

Spotlight only provides the functionality of The Spotlight Link and other services. It is not responsible for the content of the job adverts or the actions of the casting professionals or any subsequent employer.

Spotlight's database contains information about Spotlight Members which is provided by the performing artists themselves, or their Agents.

Spotlight does not endorse or approve any Agents or Spotlight Casting Subscribers (or their employers). Spotlight Members should make their own enquiries of prospective Agents or hirers and satisfy themselves as to their credentials.

Spotlight does not endorse and is not responsible for any third party packages or systems that help manage information or workflow, even if approved by Spotlight. Spotlight will not be liable for any consequences arising from the use of such packages or systems.

Those employing Spotlight Members  or specialists must make their own enquiries of the Spotlight Member/specialist to satisfy themselves that they are competent to perform the skills required.

Vetting

Please note that each Spotlight membership category will have its own vetting criteria for membership. Your membership may be refused based on the criteria set in each case.

Information supplied

You promise that all information provided by you is truthful, honest and accurate. Spotlight reserves the right to edit the information you supply, if it is more than sufficient for suitable display, or to amend or refuse or substitute any information tendered if Spotlight reasonably considers it unsuitable or inconsistent with the general standard, appearance or policy of Spotlight. You must not upload material that is unlawful, defamatory, abusive, obscene, discriminatory or otherwise inappropriate.

It is the responsibility of the person submitting information to ensure that no Personal Data ('Personal Data' in this context means data covered by current European and UK Data Protection legislation) is included that should not be listed/published relating to services intended for public or promotional use. You agree that Spotlight is not liable for Personal Data appearing where this has been supplied to us for publication.

Content and clearances 

It is the responsibility of the Spotlight Member/Subscriber to ensure that they have full copyright clearance for all photography, voice clips, showreels, materials and content featured as part of a casting breakdown, and any other content featured as part of their Spotlight account, which includes necessary permissions to edit, alter or create any content using any tools, including those available on the platform. This must be cleared for all uses set out in these terms and conditions.

It is also the responsibility of the Spotlight Member/Subscriber to ensure they have clearance to list details of productions/projects they have been involved in, or will be involved in, without disclosing confidential information which may cause harm to the hiring company concerned or their own  hirer (Production Company, Director etc.), so that confidential production information is not released.

You must not upload material that is unlawful, defamatory, abusive, obscene, discriminatory or otherwise inappropriate.

Spotlight reserves the right to suspend or withdraw services from Spotlight Members/Subscribers who violate our terms and conditions, and not to use or make available any material which it deems inappropriate, or to remove material which it considers to be in breach of these terms and conditions.

If there is a dispute, Spotlight will take your material offline until you clear the right to use the material.

Profile photographs

You must provide us with the name of the photographer for all photographs submitted to Spotlight. Photographers must be credited, according to copyright law. We reserve the right to refuse any photograph which we consider unsuitable or inappropriate. If other parties are identifiable in photographs, you must have the explicit consent of those parties. Spotlight will always hold an approved main photograph for you. In the event that you wish to replace/substitute your main photo we must approve the new one first. 

Restrictions and responsibilities

The Content and/or information sent or made available via The Spotlight Jobs Feed or otherwise on the Site is the confidential information and copyright of the relevant sender or provider (or of their employer). In using The Spotlight Jobs Feed, you agree not to forward or copy any part of this information and that you will only use the casting breakdowns, and the information set out in them, for the purposes of suggesting yourself (as a Spotlight Member) or clients (as an Agent) for the relevant casting opportunity, by, and only by, using the link provided in the system to send proposals back to the relevant Spotlight Casting Subscriber.

All production information (including individual roles/casting breakdowns) sent by Spotlight Casting Subscribers should be treated as strictly private and confidential and details should not be released to any other parties or shared outside the Spotlight platform. Agents or Spotlight Members will be liable where they, or their employees or clients, cause damage (including financial loss) to a hirer by releasing confidential production details in advance of this information being in the public domain.

Single user restriction and multi-user access

You must not share your user details with anyone else. Sharing a password may mean someone accessing the Spotlight services who is not eligible to do so. Password sharing is a breach of our terms and conditions. 

Should you work for a company wishing to gain multi-user access to Spotlight services please contact us for further advice and information about current pricing.

When using multi-user access to Spotlight services, it is the responsibility of  the company (including agencies and casting companies) to monitor and manage who has access to Spotlight services and information including removing access for users when they leave the company.

Site Content reuse/restrictions

You may use Spotlight for professional purposes only. You may not promote other services within Spotlight's Site or tools, nor require or suggest that submissions may be received by any means other than Spotlight.

Spotlight Members and Agents

Spotlight Member Profiles

Your Spotlight profile is considered to be a promotional tool for you, and a means for you to obtain exposure to potential hirers. This is how Spotlight will, or will allow others, to make them available:

Your profile/entry - showing your professional details can be accessed in the following ways:

  • By you/your agent (or representative) passing on access details which may be in the form of a hotlink (this could also include a direct link from your agent or representative's own website) or using it for another method as a means to promoting you.
  • By a Spotlight Casting Subscriber or other industry professional, using the site or digital edition, sending on a link to your profile (for instance a casting director sending a link to the director of a production so that they can assess your suitability for a part.
  • By a hirer using a link to your online profile as part of a production promotion (where agreed with you).
  • By Spotlight Casting Subscribers and their invited team Members and Clients as part of the Spotlight Casting tools.
  • Where other formats are offered by Spotlight at time of joining or renewal.
  • By you or your agent, or a hirer, copying your information or otherwise linking to it or accessing it from Spotlight approved third party project or workflow management systems.

Because of the promotional nature of your online profile, Spotlight cannot control its circulation by those parties mentioned above. We also cannot control disposal or redistribution of our online/printed/digital products.

Jobs Feed Access

Spotlight’s purpose as a casting platform is to provide professional performance opportunities to our members. As such, we remain completely impartial and do not have any involvement in the relationship between a Spotlight Member and their Agent. A Spotlight Member’s access type for the Jobs Feed (i.e. self-submitting, nudge, read-only) is based on agreements between the Agent and Spotlight Member, to which Spotlight does not control or interfere with. If a Spotlight Member  has multiple agents, in order for the Spotlight Member to have a particular type of access to the Jobs Feed, all Agents will need to provide the same access level, as agreed between Agent/s and Spotlight Member.

Content of casting notices

Spotlight does not have access to the casting notices prior to them being sent out, and cannot take responsibility for information included in them. Spotlight does however apprise our Spotlight Casting Subscribers of their responsibilities in line with related legislation. 

The Content and/or information sent or made available via the Jobs Feed or otherwise on the Site is the confidential information and copyright of the relevant sender or provider (or of their employer). For more information see Restrictions and Responsibilities. 

Spotlight Member Names

We recommend that every Spotlight Member uses one unique, professional name across the industry, to avoid confusion with another Spotlight Member. We reserve the right to refuse membership or withhold a name change request if your name is not sufficiently different from another Spotlight Member, or for any other reason related to our terms of service. You may be asked to change your name if it is already being used, or a refund will be given for your membership. 

Please be aware that acceptance of a name by Spotlight does not guarantee that the Spotlight Member's use of the name will not result in trademark infringement actions, or actions for passing off, or other actions by other parties, and that it is the Spotlight Member's sole responsibility to deal with any such claim. Spotlight will not be able to intervene in disputes between Spotlight Members/agents regarding name registrations on Spotlight, whether this be in relation to trademarked names or otherwise. In such instances, complainants would need to seek contact with the other party.

Young Performers 

Young Performers must be 4 - 17 years old. If you are 18 or over you must apply as a performer. Young performers must also be represented by an Agent to join and remain with Spotlight. For young performer Members, details may be provided by an Agent or School, or by a parent/guardian completing an application via a link provided by the Agency or School.

Management of profiles

Members are responsible for all activities on your account/profile and must keep sign in information secure and confidential. If sign in details are shared with an Agent or any other parties, they must be authorised and instructed appropriately, and this is done at their own risk.

We understand that you may employ an Agent or Manager/Representative to manage your activity for you, or whilst undertaking training your training establishment may manage such activity. It is your (the Spotlight Member's) responsibility to ensure that, and you confirm that, any person, including your Agent or Training Establishment, who accesses your account/profile, or takes actions on your behalf, whether using your sign in, or otherwise, is fully authorised by you, and is entitled to take actions on your behalf and to contractually bind you.

Membership fees/payment

Your Spotlight Membership is renewed by way of an annual or monthly membership fee, except in relation to the other Services.

Brand new Spotlight Members (those who have not been in Spotlight before) joining Spotlight may cancel their Spotlight membership, and receive a full refund, at any time within 7 days of our acceptance of your application with you having agreed to these terms and conditions, without incurring any fee or penalty. For certain membership groups your card may be pre-authorised, which creates a hold on your card until payment is taken or the transaction cancelled. No refund is available on any Spotlight membership after this period.

Submission of your application amounts to an offer by you to purchase a Spotlight Membership, and is subject to our acceptance. Your Spotlight Membership starts on our acceptance of your application.

Deceased Members

In the event of the death of a member, the estate can inform Spotlight of this by contacting us. The estate may be required to provide a copy (not an original) of the death certificate which will be deleted as soon as it has been reviewed and verified. Once this has been verified, Spotlight will take appropriate actions in terms of administering the deceased member's profile and account.

If the deceased member's Spotlight membership was paid by card or annual direct debit, the estate may be entitled to receive a refund of unexpired whole months of the year's membership from the date of death. If the membership was paid by monthly direct debit then payments to Spotlight will automatically be stopped when the deceased's bank becomes aware of the death from the estate.

Agent sign up process

Spotlight has a formal registration procedure for Agents and access will only be provided to agents where their professional background can be assessed. We additionally hold information about agencies, and provide agency services, only if they have clients who are appearing in Spotlight (Spotlight Members) who choose to publish a particular agency as their representative on their Spotlight profile. When one or more clients add an agency to their Spotlight profile the agency will be eligible to receive certain contents of Breakdowns (with the exception of children and young performers' agencies, who need to have eight or more clients in Spotlight). You will be informed by an auto-generated email and will then be asked to set up a confidential username and password. You will then automatically start to receive casting information. Once a fifth Spotlight Member informs us that you are their representative, you will have full access.

Agents acting on behalf of Performers

We contract with Spotlight Members, not Agents, and allow Agents access to Spotlight on behalf of their clients, on an at will basis. As an Agent, you agree to these terms and conditions relating to Agent Services, but also acknowledge and agree to abide by these terms on behalf of any of your clients who are Spotlight Members.

To act on behalf of your clients as Spotlight Members you must be authorised by a Spotlight Member (your client), or their parent/guardian as appropriate (all responsible parties must agree on consent), and you hereby confirm that you are so authorised by your client(s) or their parent/guardian as appropriate (all responsible parties must agree on consent), to access and/or administer their account/profile in a professional manner, and to contractually bind them in relation to the Spotlight Member Services and otherwise as appropriate.

Agents as the Data Controller

You confirm your understanding of your role as Data Controller, in line with current legislation, in regard to the administration of your clients' data. In particular for data protection reasons you need to satisfy yourself, and you confirm to us, that you have consent from your clients (or their parent/guardian (all responsible parties must agree on consent)) to:

  • (i) use and submit their personal data to Spotlight for use in accordance with the Spotlight Member Services and the Privacy Policy, 
  • (ii) submit them for specific casting opportunities available via Spotlight, and 
  • (iii) to promote them using their Spotlight profile and profile access information (particularly when passing their data to third parties, or publishing it or linking to it on public facing websites and similar). 

You also consent to your own details being made available via the Jobs Feed to casting professionals, for them to use to send you casting breakdowns. You have responsibility for ensuring  Spotlight Members are aware that you are the Data Controller of this information. Please note that if Spotlight receives requests relating to data for which you are the Data Controller, Spotlight will notify the respective requestor to submit their request to you as the Data Controller.

It is the responsibility of Agents to contact Spotlight and ensure they have suitable consent before moving any Spotlight Materials and Data into third party systems or software.

Spotlight does not verify, endorse or approve any Agents. Agents should not present themselves as having any relationship with Spotlight other than as set out herein.

Management of Agency accounts

Please note that administrative rights to Spotlight agency accounts are held by the Agent concerned (Business Owner) and not by the individual agency employees, and therefore access to any account attached to that Agent (or details of any activities undertaken on an associated agency account) will be given to Agent administrators 'Main Users' by Spotlight on request. In the event of any issues or disputes Spotlight will take instruction only from a Business Owner. Agent employees should additionally be aware that they have no right to gain access, or attempt to gain access, to their Spotlight agency account once they have left employment with the Agent concerned, unless an agreement is in place with the Business Owner.

Please be aware however, that Spotlight is a professional database and we have strict criteria relating to industry training or experience when vetting our Spotlight Members, which they will need to fulfil.

Casting

Casting user as a Data Controller

You confirm your understanding of your role as Data Controller, in line with current legislation, in regard to the administration of your data in finding and hiring professional Spotlight Members, working with agents, and collaborating with other project members. This includes information you send, manage and receive through the Spotlight platform, lists and notes you maintain, self-tape related information, and any information you take the decision to share with other parties outside of Spotlight such as with your hirer and other collaborators. You have responsibility for ensuring Spotlight Members and agents are aware that you are the Data Controller of this information. Please note that if Spotlight receives requests relating to data for which you are the Data Controller, Spotlight will notify the respective requestor to submit their request to you as the Data Controller. 

Payment Terms

The placing of an order amounts to an offer to join, subscribe or purchase as appropriate. All offers are subject to our acceptance.

Spotlight must normally receive payment of the whole of the price for the services that you order before your order can be accepted, either by payment in full or by setting up a valid Direct Debit mandate. It is not our policy to offer credit accounts for payments. Please do not be offended if we refuse your request.

If you are a brand new Spotlight Member, please ensure you have read and understand the terms around your cancellation period. For certain membership groups, if paying by card, your card may be pre-authorised, which creates a temporary hold on your card and reserves funds until payment is taken or the transaction is cancelled.

When purchasing a casting subscription, once you have completed your company/individual information you will proceed to a checkout screen. After you submit your Spotlight Casting Subscription application our online payment provider will process your payment automatically. This does not represent acceptance of your order by us. Your professional credentials will subsequently be verified, and your first casting draft reviewed if you are using the Jobs Feed, and we reserve the right to refuse your order and refund your purchase costs at any stage. We additionally reserve the right to refer to other professional bodies, such as Equity, if we have specific concerns regarding company background or information supplied (such as terms of employment or similar).

You will be charged in the currency as indicated at the checkout which, if not the country of your bank account, will be converted by your bank into the currency of your bank account, when processed. We are not responsible for any additional fees your own bank may charge.

We accept Visa, MasterCard, Maestro (Switch), debit card, CHAPS, Direct Debit or, in some cases, bank transfer. We do not accept American Express or Diners Card. 

Should we need to refund you for any reason, we will refund to the card or other payment method on which the order was placed.

Once you have submitted your payment details, your order will automatically proceed and we will not be able to stop the payment going through at this stage. Should you have any concerns regarding a payment that has been sent through for processing, please contact us.

Should you receive an invoice from us, or receive a service from us without paying in advance or on the day, the payment terms will be stated on the invoice, if applicable, or due immediately. We reserve the right not to proceed with additional services, even if a deposit or full payment has been made, until all due payments have been received.

Spotlight reserves the right to charge interest monthly in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 for late settlement of accounts from the due date up to the receipt of payment. We may also seek to recover your Debt Collection Agency costs.

You can also pay your annual membership fee by annual or monthly Direct Debit.

Once your Direct Debit is set up it enables you to automatically pay your membership fee each year, or by month, until you cancel your Direct Debit. With annual Direct Debit, your contract is for a year's membership. With monthly Direct Debit, there is no minimum contract length.

If you do not wish to continue paying by Direct Debit, you must contact your bank about the Direct Debit, and also Spotlight to arrange for an alternative payment method. Please note, this will not automatically cancel your membership, which may continue until cancelled with Spotlight in accordance with these terms.

Spotlight reserves the right to remove or refuse, for any reason whatsoever and at any time, the ability for a Member to choose to pay by Direct Debit.

It is important that you keep your email address for Direct Debit communications up to date.

We reserve the right to make price changes to future membership fees. This will not affect your payments already made. We will always notify you of any changes in fees in advance of your annual or monthly membership renewal.

Cancellations and Refunds

Spotlight reserves the right to refuse or cancel membership/services for any Spotlight member, agent, casting subscriber or casting invitee. In the event that membership or subscription is cancelled or refused at will by Spotlight, a full refund will be given (see Right to refuse orders for refund exemptions).

We additionally reserve the right to terminate Spotlight memberships, subscriptions and accounts temporarily or permanently where:

  • our staff or other persons are subject to abusive, offensive or threatening behaviour;
  • information supplied cannot be validated; 
  • there are fraudulent applications or activities (or where there is legitimate suspicion of same);
  • the vetting/joining criteria is no longer met; 
  • having the person/company on the platform would be detrimental to other person(s)/company(s) using the Spotlight platform; 
  • we may see information about a person/company in the public domain which suggests having them on our platform may cause reputational damage to Spotlight or be detrimental to other person(s)/company(s) using the Spotlight platform; and
  • where we are complying with sanctions regulations in countries where we operate. 

Please note that we cannot always act on complaints received or information that becomes known.

If the service you have ordered is no longer available Spotlight will notify you as soon as possible, and any sum debited by us from your credit or debit card, or collected by Direct Debit, will be re-credited to your original payment method. Spotlight will not be obliged to offer any other replacement or compensation in the event of this happening.

Spotlight is entitled to withdraw from any purchase agreement in the case of obvious errors or inaccuracies regarding the services appearing on our Site. If an error or inaccuracy is discovered with regard to the advertised price of the services that you have ordered, we will contact you as soon as possible. This will be to inform you of the correct price of the services, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

Members and subscribers cancelling Spotlight membership

You will be contacted each year to confirm that you wish your Spotlight Membership to continue. Should you decide to terminate your Spotlight Membership then your profile will still be available for the duration of time quoted at your last membership renewal. Should your Spotlight Membership lapse, we may endeavour to offer you another chance to re-join and will retain the necessary amount of personal and professional data in order to meet this purpose. We do not guarantee to make these follow-up offers.

If you contact us and ask to cancel with immediate effect we will then remove your online profile (including any multimedia attached) immediately. As per the payment terms, you would not be eligible for a refund in these circumstances.

When a Spotlight Member cancels their membership we retain their contact details in our internal database in line with our retention policy for reference purposes, for the following reasons:

  • For beneficial professional enquiries (former Agents/Hirers trying to contact you via Spotlight with outstanding payments, etc.) in which case we may attempt to contact you to pass on a message.
  • Some details are also retained so that when you next re-join Spotlight you are recognised as an approved former Spotlight Member and your online profile can be activated as quickly as possible.
  • To ascertain the previous membership status of those applying for future Spotlight Membership, in order to administer cancellation periods and similar where required.

However, once you are no longer a Member no new casting enquiries will be forwarded.

Zero-rated invoices for UK VAT

If you ask for your invoice to be zero-rated for UK VAT, you will be required to provide proof of your address (that will be stored in line with applicable legislation) and VAT registration number (where applicable). Please note that we are unable to zero-rate room hire, no matter where you are based.

If it is subsequently found that your invoice should not have been zero-rated, we will send you an invoice for the underpaid VAT, which you will be obliged to pay.

Right to refuse orders

We reserve the right to refund your money and deny access to the Services or withhold orders:

  1. If we are unable to verify your relevant credentials.
  2. If we find orders have been made with false information, or where we find that there has been any fraudulent or criminal activity associated with the person or company concerned.
  3. In the event of obvious inaccuracies in prices, except that we may fulfil your order at the correct price.
  4. If we are unable to obtain payment authorisation from the issuer of your payment card.
  5. If you are found not to meet the relevant membership criteria.
  6. If there is a risk that may bring the company into disrepute or cause reputational damage.
  7. If we are complying with sanctions regulations in countries where we operate.

Discounts and Offers

All offers and discounts provided by Spotlight are subject to availability and supplied at our discretion and as available at that time. Discounts and offers are not retrospective. For certain ongoing discounts, such as those on membership fees, supporting evidence may be required at intervals. Spotlight reserves the right to amend and/or refuse offers and discounts at any time.

Other services and terms 

Spotlight Contacts

You acknowledge that all copyright, trademarks and all other intellectual property rights in the Sites and Content, or any Associated Products, belong to and shall remain vested in us, our licensors, our Advertisers or those with an Enhanced Listing or Free Listing. You are cautioned against breaching our Terms & Conditions or inappropriately or unlawfully using any of the Content of this Site, the Contacts publication or any Associated Products wholly or in part. Traceable material of an insignificant nature is incorporated throughout to detect unauthorised use.

Advertisements, Enhanced Listings and Free Listings

All Advertisements, Enhanced Listings and Free Listings are accepted subject to Spotlight's approval of the copy.

Those supplying Advertising or Listings grant Spotlight the right to use such Content and materials for all related purposes, including editing, copying, reproduction and publication.

Spotlight reserves the right to refuse, omit, amend (including editing of excessive copy), suspend or remove Content at any time, in line with our editorial policy but also for any other operational reason.

It is the responsibility of the person supplying Content to ensure that they are authorised to do so and that they do this within the timeframes stated by us.

Contacts Liability/Disclaimer

The Content, opinions and statements of third parties supplying Advertising, Listings, articles or opinion for Contacts are theirs alone, not the Content/statements/opinions of Spotlight. Content created by third parties is the sole responsibility of that third party and cannot be endorsed or guaranteed by Spotlight. Spotlight has no responsibility or liability for issues that may arise from third party Content. Whilst Spotlight cannot accept any liability for Content supplied by third parties we commit to using best endeavours to remove Content deemed to be inappropriate once a complaint has been upheld.

The Advertiser or person supplying an Enhanced Listing or a Free Listing will ensure that this is not in breach of these Terms & Conditions, illegal, a breach of another party's rights, or an infringement of accepted UK advertising practices or codes of conduct. The Advertiser or person supplying an Enhanced Listing or Free Listing will indemnify Spotlight fully in respect of any claim made arising from the content of Advertisements or Listings.

Spotlight Performance Calendar

The Spotlight Performance Calendar enables Spotlight-approved schools to promote their students' performances and showcases to agents and casting professionals. Information published via the calendar is publicly available and includes times and dates, venue details and maps, and may include personal information such as a Spotlight Member name, which can be linked to a Spotlight Member's public profile. Information must only be submitted where the user has the consent from the educational establishment to use the system. Personal information must only be submitted where students have authorised their education establishment to administer their profile for promotional purposes. Where the Spotlight Member is under the age of 16, the parent or guardian's consent must be gained.

Multimedia Services

Spotlight Members/Agents can add new photographs and video to their online profiles at any time by signing into the site.

Media storage services will be withdrawn upon expiry or withdrawal of an individual's Spotlight Membership(s). 

Spotlight reserves the right to delete all or some of a Member's media on expiry of their Spotlight Membership(s) or for any other reason, including, but not limited to, withdrawal of media upload services for whatever reason.

Spotlight does not offer its Spotlight Members the ability to download or otherwise recover media files in their original quality or format. Spotlight therefore strongly recommends that Spotlight Members retain their original media files. Furthermore Spotlight cannot be held responsible for loss or corruption of data, including accidental or intentional deletion by either party.

Spotlight Discounts

Spotlight Discounts is free to our Spotlight Members and gives you access to a huge variety of savings, letting you make savings on everyday purchases. To access Spotlight Discounts simply sign into your home page and click on the Spotlight Discounts button. Please note that Spotlight Discounts is provided by Parliament Hill (third party) and Spotlight is not responsible for these third party offers.

Definitions

"Agent" means an authorised agent of a performer, who is a Member of Spotlight.

"Agent Services" means the services made available to Agents as detailed below and on the Site.

"Content" means the information and other material or applications available within the Site(s).

"Spotlight Casting Services" means the services made available to Casting Subscribers.

"Spotlight Casting Subscriber" means a casting professional who has signed up with Spotlight as a recipient of the Casting Services.

"Spotlight Casting Invited User" means a user invited to use the Spotlight Casting service as a 'Team Administrator', 'Team Member', 'Collaborator' or 'Client'

"Spotlight Member" means a performer, young performer or graduate who has signed up with Spotlight as a Member of its database and recipient of the Member Services, and has an active subscription.

"Spotlight Member Services" means the services that may be made available by Spotlight to Members as detailed below and on the Site.

"Sales and Payment Terms" means the further specific terms relating to the processing of any payments.

"Services" means various Spotlight Member, Agents, Casting, Shop and Rooms/Studio services that may be made available by Spotlight from time to time.

"Site" means the sites located at spotlight.com and spotlight.com/contacts. 

"You" means the user of the Site(s) or the Content or otherwise the Member/Subscriber/Account user.

"we/us" means Spotlight.

"Advertiser" or "Advertisement" or "Advertising" means the party to whom Advertising Services are supplied, and said Services.

"Enhanced Listing(s)" means a contact Listing within Contacts where payment has been made to enhance the Listing.

"Free Listing(s)" means a contact Listing within Contacts where payment is not required.

"Listing(s)" refers to both Enhanced Listings or Free Listings.

"Associated Products" means any additional Contacts products, such as printed titles or Apps.

"Purchaser" means a customer purchasing access to Contacts or any additional products.
